Make No Error – Rescission of contracts for the sale of land

Sydney presented a CPD seminar for the Law Society of NSW titled “Make No Error – Rescission from Contracts for the Sale of Land” on 14 March.

The presentation explored the origins and present state of the law regarding rescission from contracts for the sale of land, particularly as applied to sales off-the-plan. Beginning with the common law rule in Flight v Booth, Sydney traced its core underlying principles to the modern legislative scheme set out in the Conveyancing Act, Conveyancing (Sale of Land) Regulation and the Residential Apartment Buildings (Compliance and Enforcement Powers) Act, extracting useful lessons for property practitioners.
